Hearings in Tournai

The Tournai division of the Hainaut court of first instance sits in town, as do the justice of the peace and the labour court. The sworn interpreter reports at the time of the summons and stays until the case is done.

Why not a relative

The temptation makes sense: someone in the family speaks both languages, knows the matter and will gladly come along. The registry will refuse, and that is not red tape.

A sworn interpreter has taken an oath, appears in the national register of judicial experts and has no interest in the outcome. A relative necessarily has one: he summarises, he softens, he corrects whatever strikes him as clumsy. There is no ill will in it, but the rendering stops being faithful and the decision then rests on a retouched account.

We check the register entry for every assignment, and the interpreter steps aside the moment he recognises one of the parties. If that happens we replace him, including on the eve of the hearing. There is no other acceptable answer.

Whatever is spoken reaches the other language: a hesitation, a contradiction, a sentence that collapses halfway. He tidies nothing and adds nothing, even when an answer strikes him as unfinished.

He gives no advice

No legal explanation, no suggested answer, no comment while the sitting is suspended. That is your lawyer's role, and it is not shared.

He declares any connection

If he knows a party, a witness or one of the lawyers, he withdraws before the sitting. We replace him without discussion, and the assignment is not charged to you twice.

He is bound by secrecy

What is said during the assignment does not leave the room, and that duty does not lapse once the file is closed.

Is my case heard in Tournai or in Charleroi?
